3              Accessibility and alternative formats

9              Software

11           Our responsibility to you

11.1        If we breach these Terms or are negligent, we are responsible to you for loss or damage you suffer that is a foreseeable result of our breach or negligence. When we say ‘foreseeable’ we mean that, at the time these Terms were formed, it was either clear that the loss or damage would occur or you and we both knew that it might reasonably occur, as a result of something we did (or failed to do).

11.2        We are not responsible for any loss or damage that was not foreseeable. We are also not responsible for any loss or damage that was not caused by us, or which results from your breach of these Terms, your internet connection, or any third party systems out of our control.

11.4        We do not exclude or limit liability where it would be unlawful to do so, including for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Nothing in these Terms limits the rights and remedies you are entitled to under consumer protection law.

12           Suspension and termination

12.1        We reserve the right to suspend or terminate your access to our Site if you breach these Terms, or where this is considered necessary for security, legal or fraud-prevention reasons.

13           Your privacy and personal information

14           Financial Services

14.1        Where the Website or any other of our promotional literature or materials refer to the provision of financial services by the Firm (such as our ability to help clients arrange after the event legal expenses insurance or title indemnity insurance), we are not authorised by the Financial Conduct Authority. However, we are included on the register maintained by the Financial Conduct Authority so that we can carry on insurance distribution activity, which is broadly the advising on, selling and administration of insurance contracts. This part of our business, including arrangements for complaints or redress if something goes wrong, is regulated by the Solicitors Regulation Authority. 14.2        We are also not authorised by the FCA to provide investment advice services. If you need advice on investments, we may refer you to someone who is authorised by the FCA to provide the necessary advice. However, because we are regulated by the SRA, we may be able to provide certain limited investment advice services where these are closely linked to the legal work we are doing for you.

16           The duration of Cookies

16.2        Session Cookies – these allow our website to link  your actions during a particular browser session. These expire each time you close your browser and do not remain on your device afterwards.

18           General legal terms

18.1        Changes to these Terms: We may make changes to these Terms to reflect changes in law or regulation, changes to the Site and its functionality, or for security or operational reasons. When we do this, our updated Terms will be displayed on the Site with a ‘last updated’ date. Where a change might materially impact you, we will make reasonable efforts to notify you. If you continue to use and access the Site following these changes, you agree to be bound by the updated Terms.

18.2        Events beyond our control: We are not liable to you if we fail to comply with these Terms because of circumstances beyond our reasonable control.
